This question has come up and I am writing to see what answers we get.

The question is-- when a Driver for an Owner Operator is paying for the fuel... can he take the fuel he pays for off his taxes?? A tax person is telling my driver that he cannot take the fuel he pays for off his taxes because he doesnt own the van. I find this odd and thought that he could.

Can anyone show some light on this?

Yes, he certainly can. In that scenario the driver is considerd a subcontractor, and can write off all of his own out of pocket expenses regardless if he owns the truck or not.
