By unloading the truck, the forklift driver from UPS did not calculate the height of his forklift before entering the cargo box to unload.
He got stuck with his forklift at the top of the rear opening and ripped off the whole top frame.

After calling UPS several times they finaly paid the repair of the truck, but not for the down time of 16 days.

When we spoke to the manager of UPS Supply Chain Solutions in Memphis,TN about our claim, the manager advised us That it is the policy of UPS not to pay for down time.

Lost income resulting from lost time in operating the truck is a reasonably
foreseeable damage resulting from the negligence of UPS's forklift driver.

So guy's and girl's if you ever get involved with a UPS vehicle, make it your policy too, no down time payment for them.

Sue them....Let a judge sort it out, Theres no way that the decsion would go against you due to someone elses stupidy

Half a month down time on account of the fork lift drivers stupidity,i would also advise seeking legal advice.

For sure. That may be their policy, but it doesn't apply to you. Go get them.

Yep, you gotta set your policy, and make the claim. Do your homework, show what the truck earned the last 90 days, devide it by 90, times 16. And don't forget the costs to collect. My company policies don't always jive with other company policies, so, you need to negotiate. If they don't want to negotiate, play hardball. I'll bet if they have downtime the policy is a bit different. Whatca think??
